Privacy Policy

This policy explains how MathemaTech ("MathemaTech," "we," "us," or "our") handles personal information when you use our websites, Fermat products and services, communicate with us, or apply to work with us.

1. Scope and privacy framework

This policy applies to personal information under MathemaTech's control. It does not apply to third-party websites or services that have their own privacy policies. We handle personal information in accordance with applicable Canadian privacy law, including the Personal Information Protection and Electronic Documents Act (PIPEDA) where it applies.

2. Information we collect

Depending on how you interact with us, we may collect:

  • Contact and account information, such as your name, email address, telephone number, login details, and communication preferences.
  • Learning and service information, such as subjects, languages, learning goals, preferences, messages, work you submit, lesson activity, and support requests.
  • Transaction information, such as billing and transaction records when you purchase a paid service. Payment card details may be collected directly by a payment processor rather than by MathemaTech.
  • Application information, including your contact details, location, LinkedIn profile, resume, qualifications, languages, subjects, availability, eligibility confirmations, and anything else you choose to provide.
  • Technical and usage information that our servers and service providers may receive, including IP address, browser and device type, approximate location derived from IP, pages visited, referring page, timestamps, error records, and interactions with our services.
  • Information from others, such as a parent, guardian, school, organization, reference, or service provider, where they are authorized to provide it or the law permits us to collect it.

We ask that you provide only the information reasonably needed for the relevant purpose. Do not send sensitive information unless we request it and explain why it is needed.

3. How we use information

We may use personal information to:

  • provide, operate, personalize, and support our services;
  • create and administer accounts and transactions;
  • generate educational content and responses through Fermat's automated systems;
  • communicate with you about requests, services, security, and important changes;
  • assess and administer applications and consider candidates for roles for which they apply;
  • maintain safety, prevent misuse and fraud, troubleshoot, and protect our rights and systems;
  • understand service performance and improve our products using aggregated or de-identified information where practical; and
  • meet legal, regulatory, tax, and accounting obligations.

If we want to use personal information for a new purpose that is not reasonably expected from the context, we will explain that purpose and obtain any consent required by law.

4. Consent and your choices

We seek meaningful consent for the collection, use, and disclosure of personal information unless the law allows or requires us to act without consent. The form of consent depends on the sensitivity of the information and the reasonable expectations of the person involved.

You may withdraw consent, subject to legal or contractual restrictions and reasonable notice. Withdrawal may prevent us from providing a requested service or continuing an application. We will explain the consequence when you make the request. Marketing messages, if offered, will include a way to unsubscribe.

5. When we disclose information

We may disclose personal information:

  • to service providers that perform functions on our behalf, such as hosting, cloud storage, communications, payment processing, customer support, security, analytics, AI-enabled service delivery, and application management;
  • to a parent, guardian, school, or organization that arranged or administers a service, where disclosed at collection and with appropriate authority;
  • where reasonably necessary to comply with law, legal process, or a lawful request; protect rights, safety, or property; or investigate fraud or misuse;
  • in connection with a proposed or completed financing, merger, acquisition, reorganization, or sale, subject to appropriate confidentiality protections; or
  • as otherwise directed or consented to by you.

Service providers are permitted to handle information only for the services they provide to us and must protect it appropriately. We do not sell or rent personal information.

6. Automated systems and educational content

Fermat uses automated and artificial intelligence systems to generate educational content and responses. Information you submit through those features may be processed by these systems and by service providers acting for us to deliver the feature, maintain safety, and troubleshoot. Automated output can be incorrect, so it should not be treated as professional advice or as the sole basis for an important decision.

7. Cookies and similar technologies

We and our service providers may use cookies, local storage, and similar technologies that are necessary to operate and secure our services, remember choices, or understand performance. Where a technology is not necessary, we will provide any notice and choice required by law. You can also control cookies through your browser, although blocking necessary technologies may affect site features.

8. Children and students

Our educational services may be used by young people. Where a person cannot provide meaningful consent, we require authorization from a parent, guardian, school, or other authorized person. Except in unusual circumstances, this includes children under 13. For youth who can consent for themselves, we present privacy information in a way appropriate to their maturity. Tutor applications are limited to people who are at least 18.

9. Processing outside Canada

MathemaTech or its service providers may process or store personal information in Canada, the United States, or other countries. While outside Canada, information may be subject to the laws of that jurisdiction and may be accessible to courts, law enforcement, or national security authorities. We remain responsible for personal information transferred to a service provider for processing and use contractual and other measures appropriate to the information.

10. Retention

We keep personal information only as long as reasonably necessary for the purposes described in this policy, to meet legal or contractual requirements, resolve disputes, and enforce agreements. Retention varies by record. When information is no longer needed, we securely delete, destroy, or anonymize it. Anonymized information that can no longer identify an individual may be retained.

11. Safeguards

We use administrative, technical, and physical safeguards that are appropriate to the sensitivity, amount, format, and storage of the information. These include limiting access to people who need it, service-provider controls, and security measures designed to protect against loss, theft, and unauthorized access, use, modification, or disclosure. No method of transmission or storage is completely secure. If a privacy breach meets an applicable reporting or notification threshold, we will notify affected individuals and regulators as required by law.

12. Access, correction, and complaints

You may ask whether we hold personal information about you and request access to or correction of that information, subject to limited exceptions in law. You may also ask questions, withdraw consent, or make a complaint. We may need to verify your identity before responding.

Contact our Privacy Officer at contact@mathematech.ca. We will investigate privacy complaints and respond within the time required by applicable law. If we do not resolve your concern, you may contact the Office of the Privacy Commissioner of Canada.

13. Changes to this policy

We may update this policy as our services or legal obligations change. We will post the revised policy with a new "Last updated" date and provide additional notice or obtain consent where required for a material change.
